Emulator Privacy and Cookie Policy

 

This Privacy and Cookie Policy (“Privacy Policy”) explains how data about you is collected, used, stored, disclosed and processed by Emulator when you download, install, run and/or use our software applications and any other products or services we make available to you (collectively, the “Services”) and when you otherwise interact with us.

 

In this Privacy Policy, the term “we", "our" and "us" means Emulator and its affiliated companies and subsidiaries, or any of them, and "you" or "your" means you as a user of our Services.

1.               Age restriction

 

1.1           We do not knowingly collect personal data from children under 13 years of age. If we become aware that a child under 13 has provided us with personal data, we will take steps to remove such personal data and terminate the child’s user account (if any).

 

2.              Data we collect

 

2.1           Data you provide to Emulator

 

When you provide it to us via an e-mail or support ticket, your name and e-mail address so that you can receive a response to a query.

 

If you do not wish for us to collect your PII, you should not provide it to us through the sites e-mail or contact us page. 

 

2.2           Data collected from your use of the Services

 

Emulator (or service providers acting on our behalf) may collect data about the Services that you use and how you use them. This data may be collected automatically by tracking technologies, such as cookies, web beacons, our own data collection tools or various third-party services.

 

Device information: Device-specific information, including, without limitation, technical information about your computer, system and application software and peripherals, such as your hardware model, operating system version, unique device identifiers (UDID), mobile network information (including, without limitation, phone number), device event information (such as crashes), system activity and hardware settings.

 

Log information: Information about your use of the Services, such as browser type, access data and time stamps, pages viewed, your Internet Protocol (IP) address, browsing actions and patterns.

 

 

3.              Use of data

 

3.1           We use data held about you for the following purposes:

 

(a)            to serve you, in particular:

 

(1)            to provide the Services to you and other users

(2)            to provide customer service and support

(3)            to address your queries, correspondence, concerns or complaints

(4)            to send you service messages, including, without limitation, service updates, security alerts, technical notices and support and administrative messages

(5)            to provide software updates (where applicable) and technical support services

(6)            to notify you about changes to Services, our Terms of Service or this Privacy Policy

(7)            to personalize the Services and improve your user experience

 

 

(b)            for our internal operations, in particular:

 

(1)            to develop, manage and deliver contextual and behavioural advertising, subject to the terms of this Privacy Policy

(2)            to measure and understand the effectiveness of advertising we provide to you and others

(3)            to carry out all other statistical analysis, data analysis, testing, research and troubleshooting

(4)            to develop and/or improve our products and services

(5)            to carry out financial, regulatory and management reporting, and audit and record keeping

 

(c)            for security and legal purposes, in particular: 

 

(1)            to manage, prevent, detect and investigate fraud, security breaches, violations of law, and misuse of the Services

(2)            to verify your compliance with our terms and conditions, policies and guidelines

(3)            to enforce our legal and contractual rights

(4)            to comply with applicable law, regulation, legal process or governmental request

 

3.2           We may also collect, use and share personal data to such extent and for such purposes as may be permitted by applicable law.

 

4.              Seeing third party advertisements online based on your use of the Services

 

4.1           Advertising revenue allows Emulator to support and improve the Services. Emulator allows third party advertisers to place search ads on the Services. If an advertiser places a search ad on the Services, it may collect, or we may share, certain data, including, without limitation:

 

(a)            online usage information (for example, the number of clicks on an advertisement);

(b)            technical information (for example, IP address, device identifiers, MAC address, software and hardware information and browser information); and/or

 

4.2           The advertiser may use such information for the following purposes:

 

(a)            measure the effectiveness of the advertisements;

(b)            remember your device so as to serve you advertisements online, both on the Services or when you are on other websites and apps;

(c)            send you advertising which is more relevant to you (this is known as contextual or behavioral advertising); and/or

(d)            undertake web analytics (for example, by analyzing traffic and other user activity to improve user experience).

 

4.3           Advertisers may collect this information through the use of advertising technologies such as web beacons, pixels, ad tags, cookies, and mobile identifiers, as well as specific services offered by some sites and social networks, and they may use a single tracking technology or multiple tracking technologies at the same time.

 

4.4           Please note that if you click on a third-party banner or ad on the Services, you may leave the Services and be directed to a third party website.

 

5.              Push Notifications

 

5.1           From time to time, we may send push notifications to you. If you choose to disable push notifications, you will opt out of receiving crucial account related communication. You may disable push notifications by changing your account settings.

 

6.              Sharing your data

 

6.1           We do not sell personal data to third parties for advertising or marketing purposes.

 

6.2           However, we share your data with the following categories of third parties in order to enable us to use your data for the purposes set out in this Privacy Policy:

 

(a)            Emulator affiliates and subsidiaries. This is because different entities within our group may be responsible for different activities.

 

(b)            Service providers, business partners, suppliers, sub-contractors and agents that perform services we need to provide you with the Services or to run our business, including, without limitation, IT services, cloud services, data storage, database management, web analytics, website operations, fraud investigations, marketing and advertising.

 

(c)            Law enforcement, regulatory agencies, public agencies and other third parties that Emulator in good faith believes that disclosure is reasonably necessary to (1) comply with applicable law, regulation, legal process or governmental or regulatory request or court order.

 

(d)            Third parties that we have your consent or instructions to share your personal data with.

 

6.3           We may disclose aggregated data to third parties about the use of the Services. This will not include, without limitation, data which could be used to identify you.

 

7.              Cross-border data transfers

 

7.1           In order to provide the Services, we operate and use data centres in several territories around the world. Where the laws of your country allow you to do so, you authorize us to transfer, store, process and use your data in any country that we deem necessary in order to conduct our business.

 

7.2           If we transfer and store personal data in a location outside the United States or the European Union, we ensure an adequate level of protection for the rights of data subjects based on the adequacy of the receiving country’s data protection laws or by imposing contractual obligations on the recipient of the data.

 

7.3           We will use reasonable measures to protect personal data under our control from security risks. However, no data transmission over the Internet, over wireless transmissions, and no data storage system is ever completely secure. We cannot guarantee the security of your personal data.

 

8.              Retention of your data 

 

8.1           We will not retain your personal data for longer than we need to use it in accordance with this Privacy Policy or to to comply with applicable law, regulatory requests and relevant orders from competent courts.

 

9.              Your right to manage your data

 

9.1           You have the following rights with regard to your personal data:

 

(a)            Access. You have the right to access data we hold about you. We will need you to prove your identity before we release any personal data to you.

 

(b)            Rectification or erasure. You have the right to request that we rectify or delete any personal data that we hold about you (unless we have the legal right or obligation to retain it). Even if you request that we erase your data, we may still keep it in a form that does not identify you.

 

(c)            Restriction. You have the right to restrict your use of personal data if the data is inaccurate, our use of the data is unlawful or if we no longer need to use the data for the purposes for which we hold it.

 

(d)            Change of preferences. You can change your data processing preferences at any time. For example, if you have given your consent to direct marketing, but have changed your mind, you can opt out of receiving marketing messages. See the section on “Marketing messages” above for how to stop receiving marketing messages.

 

(e)            Automated decision making. We may use your personal data to carry out automated decision-making and profiling for the purpose of identifying what data or advertising you might like to see from us. If you have any questions in respect of our automated decision-making processes or the accuracy of them, please let us know.

 

(f)             Data portability. You have the right to obtain personal data we hold about you, in a structured, electronic format, and to transmit such data to another data controller, where this is (a) personal data which you have provided to us and (b) if we are processing that data on the basis of your consent (such as your marketing preference data) or to perform a contract with you (such as to manage your online account).

 

(g)            Complaints. If for any reason you are not happy with the way that we have handled your personal data, please do not hesitate to contact us. You also have the right to raise a complaint to your local data protection regulator.

 

9.2           If you want to exercise your rights, have a complaint, or just have questions, please contact us.

 

9.3           If you ask us to stop processing your personal data in a certain way or erase your personal data, and this type of processing or data is needed to facilitate your use of the Services, you may not be able to use the Services as you did before.

 

9.4           The rights mentioned above do not extend to non-personal data.

 

10.           Changes to our Privacy Policy

 

10.1         We may make changes to our Privacy Policy from time to time, to reflect how we are processing your data.

 

10.2         If we make significant changes, we will make that clear on the Services or by some other means of contact such as email, so that you are able to review the changes before you continue to use the Services.

 

10.3         Each time you use the Services and each time you interact with us, the latest version of our Privacy Policy will apply.

 

11.           Cookie Notice

 

11.1         To make our websites work properly, we sometimes place small data files called cookies on your device.

 

11.2         What are cookies?

 

A cookie is a small text file that a website saves on your computer or mobile device when you visit the site. 11.3         Third party cookies

 

Third parties (including, without limitation, for example, advertisers and providers of external services such as web traffic analysis services) may use their own cookies or other technologies over which Emulator has no control.  Cookies placed by third parties may serve different purposes. They may be Strictly necessary, Analytical/performance, Functionality or other cookies.

 

We do not have access or control over the cookies placed by third parties and uses of such cookies are subject to their own privacy policies. We recommend that you review the privacy policies of each of our third parties.

 

11.4         How to control cookies

 

You can control and/or reject or delete cookies as you wish. For details, see aboutcookies.org. You can delete all cookies that are already on your computer and you can set most browsers to prevent them from being placed. However, if you do this, you may have to manually adjust some preferences every time you visit a site and some services and functionalities may not work.

 

Further, Strictly necessary cookies and Analytical/performance cookies are very important to the smooth running of our website. If you delete or reject these cookies, we cannot predict how our website will perform when you visit it. The security of your data may also be at risk of compromise.
